Welcome to Mind Board. These Terms of Service ("Terms") govern your access to and use of the Mind Board mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement and that all registration information you provide is accurate and truthful.

3. Subscriptions and Billing

Mind Board offers both free and premium subscription plans. Premium plans provide access to additional features, content, and capabilities as described at the time of purchase.

3.2 Payment Processing

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis at the applicable subscription rate.

3.3 Billing Cycle

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged at the beginning of each new billing cycle.

3.4 Cancellation and Refunds

You may cancel your subscription at any time through the app. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. Refunds are handled in accordance with applicable law and at our discretion.

3.5 Price Changes

We reserve the right to adjust subscription pricing. Any price changes will be communicated to you in advance, and the new pricing will take effect at the start of your next billing cycle.

5.1 Our Content

The Service, including its design, graphics, artwork, puzzles, lessons, tutorials, software, and all other content, is owned by Mind Board and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

5.2 Your Content

You retain ownership of any content you create or submit through the Service (such as gameplay data, social posts, or messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and improving the Service.

5.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you.

6. AI-Powered Features

The Service includes AI-powered features such as chess analysis and voice interactions powered by third-party providers (including OpenAI). These features are provided "as is" and we make no guarantees regarding the accuracy, completeness, or reliability of AI-generated content. AI responses should not be considered professional advice.

7. Disclaimers

7.1 Service Availability

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

7.2 No Warranty

To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.3 Third-Party Services

The Service may integrate with or link to third-party services (such as Stripe for payments and OpenAI for AI features). We are not responsible for the content, practices, or availability of any third-party services.

To the maximum extent permitted by law, Mind Board and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Mind Board and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

We reserve the right to update these Terms at any time. If we make material changes, we will notify you through the Service or by other means. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
